The user is responsible for the safekeeping and correct use of their personal information, including credentials that allow access to reserved services, as well as for any harmful consequences or prejudice that may arise for Boglioli S.p.A. or third parties as a result of the incorrect use, loss, or theft of such information, to the extent that such events are attributable to them.

1. Privacy Policy

6. Our commercial policy

Boglioli S.p.A. has adopted its own commercial policy; its mission is to sell products through its services and the Website solely to the "final consumer," meaning a natural person who acts, on www.bogliolimilano.info, for purposes unrelated to their own commercial, entrepreneurial, or professional activity, if any. If the user is not a  final consumer, they will not be  able to use the Website's services to purchase products. Boglioli S.p.A. will, in the opposite case, have the right not to consider purchase orders from subjects who are not final consumers and any other purchase order that does not comply with the Conditions of Sale and these Terms of Use.

7. Legal guarantee of conformity

All products sold on the Website are covered by the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code. The Seller is liable for defects of conformity that manifest within 24 months from the delivery of the goods; the related rights expire 26 months from delivery. For defects that manifest within 12 months from delivery, it is presumed that they already existed at that date, unless proven otherwise.

In the event of a lack of conformity, the user is entitled to have the product restored to conformity through repair or replacement, at their choice, free of charge, within 30 days of reporting; the Seller may refuse the requested remedy if it is impossible or if it entails disproportionate costs compared to the other. The user is also entitled to a proportional reduction of the price or termination of the contract, resulting in a refund, in cases provided for by law, in particular when the Seller has not carried out the repair or replacement, or has not done so within 30 days, when the defect reappears despite the remedy, or when the defect is of such gravity as to justify immediate price reduction or termination. Termination is excluded if the lack of conformity is minor.

To claim the legal guarantee, simply contact Customer Service at customercare@bogliolimilano.info, attaching proof of purchase (receipt, invoice, or bank statement). The legal guarantee is free and is in addition to any commercial warranty provided by the manufacturer or the Seller, which operates independently and does not limit the user's rights.

Returns Policy and Right of Withdrawal

Right of withdrawal

These provisions apply if the user is a consumer, i.e., a natural person who purchases on the Site for purposes unrelated to their commercial, entrepreneurial, or professional activity, and is a resident of a Member State of the European Union.

1. User's right of withdrawal

The user has the right to withdraw from the purchase contract concluded on the Site, without giving any reason, within 14 days.

The withdrawal period expires after 14 days from the day on which the user, or a third party designated by them other than the carrier, acquires physical possession of the products. If the user has ordered multiple products with a single order and these are delivered separately, the period runs from the day on which physical possession of the last product is acquired.

The right of withdrawal is granted to the user for all products, including those on sale or promotion, and its exercise is not subject to any authorization from the Seller.

2. How to exercise the right of withdrawal

To exercise the right of withdrawal, before the deadline, the user must inform the Seller of their decision by an explicit statement. They can do so, at their choice: (i) by using the online withdrawal function ("withdrawal button") available on the Site in the dedicated "Right of Withdrawal" section accessible from the footer; (ii) by sending any other explicit statement to customercare@bogliolimilano.info or to Boglioli S.p.A., Via Brescia n. 47, Gambara (BS).

The user may use the standard withdrawal form as per Annex I, Part B, of the Consumer Code, but is not obliged to do so.

If the user uses the withdrawal button, located as indicated above, after entering the order identification data and their contact details, they can confirm the withdrawal by pressing the appropriate confirmation command. The user will receive without undue delay, on a durable medium (e.g., via email), a confirmation of receipt of their declaration of withdrawal.

To meet the deadline, it is sufficient for the user to send the communication concerning the exercise of the right of withdrawal before the expiry of the 14-day period.

3. Effects of withdrawal and refunds

In case of withdrawal, the Seller will reimburse the user for all payments made by them, including delivery costs (with the exception of additional costs resulting from the user's eventual choice of a type of delivery other than the least expensive type offered by the Seller), without undue delay and in any case within 14 days from the day on which the Seller was informed of the user's decision to withdraw.

The Seller will carry out the refund using the same means of payment used by the user for the purchase, unless the user has expressly agreed otherwise; in any case, the user will not incur any costs as a consequence of the refund.

The Seller may withhold the refund until they have received the products, or until the user has demonstrated that they have sent them back, whichever occurs first.

4. Return of products

The user must return the products without undue delay and in any case within 14 days from the day on which they communicated the withdrawal to the Seller. The deadline is met if the user sends back the products before the expiry of the 14 days.

The direct costs of returning the products are regulated as follows. It should be noted that if the user uses the courier appointed by the Seller, the transport costs for returning the products will be borne exclusively by the Seller. If the user does not use the courier appointed by the Seller (remaining free to use other couriers), the costs related to the return of the products will be borne by the user.

The user is solely responsible for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics, and functioning, as they would be allowed in a physical store. Withdrawal is therefore not excluded solely because the product has been removed from its packaging or deprived of its tag or seal, subject to the exclusions indicated in point 5.

If the returned products show a diminished value resulting from handling exceeding what is necessary to ascertain their nature, characteristics, and functioning, the Seller may deduct from the refund an amount corresponding to this diminished value. Therefore, please handle the products with care and return them, where possible, with the labels attached.

5. Exclusions

Only the cases provided for in Article 59 of the Consumer Code are excluded from the right of withdrawal, including, by way of example, the supply of custom-made or clearly personalized products and the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

6. Order cancellation before shipping

Before the products are shipped, the user can request to cancel or modify the order by contacting Customer Service, without needing to activate the withdrawal procedure. The user's right of withdrawal within the terms indicated above remains unaffected in any case.

7. Applicable law 

These Terms of Use are governed by Italian law. With respect to the consumer, the choice of Italian law does not deprive them of the protection afforded by the mandatory provisions of the law of the Member State of the European Union in which they have their habitual residence (Article 6 of EU Regulation 593/2008 - Rome I). For disputes with consumers, the court of the place of residence or elective domicile of the consumer, if located in the territory of the State, has mandatory jurisdiction.
